Washington state resident sentenced for burglary and felony assault

MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma has announced the sentencing of Cody Lynn Lusk, a 35-year-old resident of Seattle, Washington. Lusk received an 84-month prison sentence for one count of burglary in the first degree in Indian Country and an additional 30 months for assaulting a spouse, intimate partner, or dating partner by strangling, suffocating, and attempting to strangle and suffocate in Indian Country.

The charges stemmed from an investigation conducted by the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department.

Lusk pleaded guilty to these charges on February 3, 2025. Investigators reported that on March 22, 2024, Lusk broke into an apartment in Muskogee with the intent to attack its resident. Inside the apartment, he proceeded to strangle and suffocate the victim. The victim managed to escape during a pause in the attack and called for help. These incidents took place within Muskogee County on the Cherokee Nation Reservation in the Eastern District of Oklahoma.

The sentencing hearing was presided over by Chief U.S. District Judge Ronald A. White at the United States District Court for the Eastern District of Oklahoma. Lusk will remain under custody with the U.S. Marshals Service until he is transported to a designated United States Bureau of Prisons facility to serve his non-paroleable sentence.
